                a.  e-Filing is relatively new, but generally available in district courts.  e-Filing is not available at present in county court.  It can be anticipated that e-Filing will be extended to county court matters.  
                b.  In family law dissolution of marriage and legal separation (DR) actions, county court unavailability would only impact civil domestic abuse permanent restraining orders filed under CRS 13-14-102.  Family law paternity (JV) actions are juvenile court cases and are not eligible for e-Filing.  Family law matters have been exempted from the cover sheet and election re C.R.Civ.P. 16.1 exclusion requirements of other civil cases. 
                c.  Sealing criminal justice records cases are civil and filed only in district court - mandatory e-Filing.
                d.  In debt collection matters, e-Filing applies only to district court cases, not county court.
                e.  There is an e-Filing charge.  Minimum cost is $4 per filing, however actual cost is dependent upon upon the number of filings, number of pages filed & whether process service mailing is designated.     
                f.  Counsel will take advantage and utilize e-Filing service to electronically file pleadings, motions, briefs, exhibits, or orders with the court and designate service via Electronic File and Serve.  If any other party or attorney has not enrolled, documents would subsequently be mailed to such party by regular U.S. Mail through the court's agent.  This procedure places prima facie evidence of notice in the court records at the time of e-Filing.
                g.  Many court divisions across the state have issued orders mandating electronic filing by counsel of all pleadings, motions, briefs, exhibits and all other documents, and it expands regularly as technological capability is established.  e-Filing in El Paso County district court divisions 1, 5, 7 and 15 became mandatory effective 7/1/03.  C.R.Civ.P. 121 §1-26, local order 2003-01 (order available in the office of Clerk of Court) and Supreme Court Chief Justice Order dated 5/9/03. 
                h.  Based upon the fact e-Filing is mandatory in many cases, e-Filing simply becomes an unavoidable cost of litigation.  Where e-Filing is mandatory, court costs of $50 per document are imposed if filed by counsel in hardcopy - the court is serious about e-Filing.  Pro se litigants (private persons without an attorney) should check with the Clerk of Court to determine cost (if any) to file documents in hardcopy.
                i.  Cover sheet and election re C.R.Civ.P. 16.1 exclusion are now required in district court civil lawsuits, including debt collection.  Family law matters have been exempted from cover sheet and election re C.R.Civ.P. 16.1 requirements.
                j.  Exceptions to mandatory e-Filing.  Documents filed under seal, petitions to seal criminal justice records (now mandatory e-Filing in most counties), the record on county court or municipal court appeals, trial exhibits for inclusion in juror notebooks and proposed jury instructions.
